Environmental Liability
Austrian Proposal on Annex III and Annex VI (based on doc. 8701/03)
This proposal represents an attempt to clarify the activities concerning the Directive on waste and
the Directive on hazardous waste. The Liability Directive shall apply to those waste management
operations which are concretised as disposal and recovery operations. This shall apply to the
relevant activities referred to in Article 3 (Annex III) as well as in Article 14 (Annex VI).

Waste management operations according to Annex II A and B of Council Directive 75/442/EEC of
15 July 1975 on waste, including the collection, transport, recovery and disposal of waste and
hazardous waste, including the supervision of such operations and after-care of disposal sites,
subject to permit or registration in pursuance of that Directive and Council Directive 91/689/EEC of
12 December 1991 on hazardous waste.
Those operations include, inter alia, the operation of landfill sites under Council Directive
1999/31/EC of 26 April 1999 on the landfill of waste and the operation of incineration plants under
Directive 2000/76/EC of the European Parliament and of the Council of 4 December 2000 on the
