CODIFICATION OF THE ACQUIS COMMUNAUTAIRE

___________________________________________

PLANNING as at 29 November 2002.

Since the launch of the project set out in the Commission's Communication of 21 November 2001 (COM (2001) 645 final) the Legal Service has made contact with all Directorates General in order (i) to establish the acquis of each Directorate General, (ii) to establish which acts are in principle codifiable, (iii) to establish an order of priority with regard to codifiable acts and (iv) to establish a working relationship.

In addition to the aforementioned framework, progress on the project which is due to be completed by the end of 2005 is conditional on the rate of progress in the consolidation of Community law by the Office for Publications, which is due to be completed by the middle of 2003. Problems regarding the 2003 budget may mean that this deadline is postponed.

In addition, it should be noted that, by virtue of point 2.5 of the Communication, no codified text will be adopted and published during a period of 9 months prior to the date of accession. Preparatory work in all 3 institutions will continue during this period with a view to publishing the codified acts immediately after accession in all (old and new) official languages.

The following is a list of the acts of the Council or of the Parliament and the Council, identified in the course of the contacts with the Directorates General, with an indication of those acts where the codification process has begun and an approximate indication of when they could be presented to the Council and the European Parliament for examination

No acts will be codified until the current administrative reform proposals have been adopted.
